after winning an appeal against his extradition to Jordan.
The Islamist preacher, described as Osama bin Laden's right-hand man
in Europe, won a legal victory in Central London today, in a deportation
saga which has cost the UK government nearly £1m in legal fees.Despite the Government declaring that it 'strongly disagreed' with the ruling, the Jordanian cleric has again avoided deportation after thwarting officials' attempts to get him on a plane.
The decision will come as a huge blow to Home Secretary Theresa May, who is due to make a statement on the issue this afternoon.
Abu Qatada is facing a retrial on terror charges after he was convicted in his absence in Jordan in 1998 for involvement in terror attacks.
The radical cleric's lawyers won the right for him to stay on UK soil after successfully arguing that he won't get a fair trial in his native Jordan.
Britain had moved to send him to Jordan after interior minister Theresa May was given assurances by the Jordanian authorities that no evidence gained through torture would be used against him in a retrial on his return.
A previous hearing on Qatada's appeal had heard that his plea against deportation 'bore all the hallmarks of a last-ditch argument'.

The Special Immigration Appeals Commission handed down its judgement on Qatada today shortly after noon, with the Home Office announcing straight away it was seeking leave to appeal the decision.
The European Court of Human Rights (ECHR) had ruled earlier this year that the 51-year-old could not be deported while there was a "real risk that evidence obtained by torture will be used against him".
But when the British immigration commission heard Abu Qatada's appeal last month its leader, senior judge John Mitting, said that some of the evidence against him was "extremely thin".
The
news of Qatada's success prompted a flurry of outraged reaction, with
many taking to Twitter to voice their displeasure that the radical
cleric had won another legal battle against the Government.

Abu Qatada is to be freed after winning his latest appeal against extradition, in a major blow to Home Secretary Theresa May.
The Special Immigration Appeals Commission (Siac) decided the radical
cleric would not get a fair trial in Jordan because evidence obtained
via torture could be used against him.This is despite the Home Secretary securing assurances from the country that this would not happen.
Qatada will be released on bail after Home Office lawyers failed to persuade Siac judges he should remain behind bars.
They insisted that the Palestinian-born Jordanian cleric, real name Omar Mahmoud Mohammed Othman, poses "an enormous risk to national security".
But Edward Fitzgerald QC, for Qatada, declared: "Enough is enough. It has gone on for many years now. There is no prospect of deportation taking place within a reasonable time, in fact there is no prospect at present of deportation at all."
The successful appeal is the latest twist in a battle that has lasted more than a decade.
Siac has already rejected the Government's application to challenge the decision but permission can still be sought at the Court of Appeal. Home Secretary Theresa May announced to MPs in the House of Commons that she will contest the ruling.
"Last year the Jordanian constitution was amended to make clear that not only is torture forbidden, but that any statement extracted from a person under duress or the threat thereof, shall neither be taken into consideration nor relied on," she said.
"Despite these assurances to allow Qatada a fair trial and despite the change to the Jordanian constitution, in the absence of clear case law, Mr Justice Mitting still found in Qatada's favour. In doing so, we believe he applied the wrong legal test."
Shadow Home Secretary Yvette Cooper agreed that, while "every avenue should be pursued" to secure Qatada's deportation, Ms May was to blame for errors which led to the Siac ruling.
"There has been a catalogue of confusion and mistakes over Abu Qatada from this Home Secretary, including getting basic dates wrong earlier this year," she said.
"The Home Secretary needs to say urgently what she is now doing to get Abu Qatada's deportation back on track and to keep the public safe in the meantime. We cannot have any more mistakes that simply leave the public at risk."
Speaking outside Siac, Qatada's solicitor Gareth Peirce said: "It is important to reaffirm this country's position that we abhor the use of torture and a case that was predicated upon evidence from witnesses who have been tortured is rejected - rejected by the courts of this country as by the European Court.
"We clearly agree with the decision, of course we do, but it is important to emphasise the fundamental rules of law that we subscribe to. To that extent, it is important for other cases, not just for this case."
Asked about the inevitable reaction of the British public to Qatada's release, she said: "We understand that this is a difficult case that has been challenging for everyone, of course we understand that.
"But I think the time has come in the world, with the conflicts in the world, for us to talk to each other and understand each other and enter into dialogue, and perhaps nothing is as black and white as it is painted."
The Home Office said the Government "strongly disagreed" with the ruling.
"We have obtained assurances not just in relation to the treatment of Qatada himself, but about the quality of the legal processes that would be followed throughout his trial," a spokesman said.
"Indeed, today's ruling found that 'the Jordanian judiciary, like their executive counterparts, are determined to ensure that the appellant will receive, and be seen to receive, a fair retrial'. We will therefore seek leave to appeal."
Qatada, once described by a judge as Osama bin Laden's right-hand man in Europe, was allowed to stay in Britain in 1994 but was convicted of terror charges in Jordan in his absence in 1999.
The cleric, who is said to have wide and high-level support among extremists, featured in hate sermons found on videos in the flat of one of the September 11 bombers.
In December 2001, he became one of Britain's most wanted men after going on the run from his home in west London. He was arrested almost a year later and detained in Belmarsh prison.
He has been in and out of jail in the intervening years and was rearrested in April amid hopes in Government that he could finally be removed from the country.
His legal team lodged a fresh appeal at the European Court of Human Rights but lost, and took the fight back to the British courts and Siac.
At the hearing last month, Jordan expert Professor Beverley Milton-Edwards warned that a fair trial for Qatada there was "unlikely".

But Home Secretary Theresa May had a narrow escape as, while they rejected the case, the panel of five judges also ruled that Qatada's appeal on the night of April 17 was within the court's deadline.
The decision means Mrs May was wrong when she claimed the three-month appeal deadline from the court's original decision on January 17 expired on the night of April 16, but the mistake will have no serious repercussions.
Qatada's legal team lodged his appeal late on the night of April 17, which the judges ruled was in time.
As is typical, no reasons were given for the panel's refusal to allow the case to be heard by the Grand Chamber of the European Court of Human Rights in Strasbourg.
Lawyers for Qatada, described by a judge as Osama bin Laden's right-hand man in Europe, also applied to a senior immigration judge at the Special Immigration Appeals Commission for a fresh bail hearing, but no date has yet been set.

The Special Immigration Appeals Commission refused the application from
the terror suspect, who was detained in Belmarsh prison in March after
allegedly breaching a bail condition which prevents him from turning
mobile phones on in his house.
Qatada, who recently indicated he was willing to leave the UK voluntarily after years fighting deportation, must remain in custody after immigration judge Mr Justice Irwin's ruling.
The judge said: "We regard these breaches as serious. It was the appellant's obligation to understand the conditions of bail and ensure they were adhered to.
"A serious matter relating to the breaches of bail was revealed during the hearing.
"In his witness statement, the appellant assured the Commission that nothing would be found on any of these items other than schoolwork or other innocent material.
"This assurance has proved untrue. Significant jihadist material has been found on a USB stick seized."
Mr Justice Irwin also said there was "no doubt about the national security threat" the radical cleric poses to Britain.
"The essence of that is promulgation of his views in support of violence, and the potential effect on others of that promulgation," he said.
"This appellant has in the past fled in order to avoid a court order, equipping himself with a false passport.
"We reject the submission that he can, even now, be relied on to comply with his legal obligations and not to attempt to abscond."
Earlier this month, it emerged the controversial preacher is willing to return to the Middle East when a treaty between the UK and Jordan is ratified by both countries.
The agreement, unveiled by Home Secretary Theresa May last month, aims to allay fears that evidence extracted through torture will be used against the terror suspect at a retrial.
Qatada's lawyer Daniel Friedman QC told the hearing that the treaty also "raises his prospects of acquittal in relation to what we say are tainted charges".
Mr Friedman argued that Qatada was a "proud and dignified man" who has been held in custody for too long.
He added his client "has been deprived of his liberty more than any other non-convicted person in British history".

At times of distress learned, authentic, wise and learning Muslims know that this is part of the design of God, and despite all the stories of the past many men and women face such tribulations with courage, faith, patience and in persevering in their efforts (jihaad) to make this world which is not ours but of which we are responsible a better place to live in for all, “the good the bad and the ugly”, by doing the right things in order to prevent, if not all, most of the causes of pain, grief and sufferings, which are definitely of our own doing, whether by direct participation in a wrongful mode of life or by our indifference to what is happening to the world we are forced to live in, and by our selfishness and personal greed for what is unlawful to us in the sight of God, and by all the standards of a decent and moral society.
Abu Qatada's
deportation is in the hands of the British courts after the Jordanian
terror suspect lost his attempt to make a final appeal to Europe's human
rights judges.
The radical cleric's lawyers immediately applied for him to be released on bail as it looked likely that deportation proceedings will still take many months.But Home Secretary Theresa May had a narrow escape as, while they rejected the case, the panel of five judges also ruled that Qatada's appeal on the night of April 17 was within the court's deadline.
The decision means Mrs May was wrong when she claimed the three-month appeal deadline from the court's original decision on January 17 expired on the night of April 16, but the mistake will have no serious repercussions.
Qatada's legal team lodged his appeal late on the night of April 17, which the judges ruled was in time.
As is typical, no reasons were given for the panel's refusal to allow the case to be heard by the Grand Chamber of the European Court of Human Rights in Strasbourg.
Lawyers for Qatada, described by a judge as Osama bin Laden's right-hand man in Europe, also applied to a senior immigration judge at the Special Immigration Appeals Commission for a fresh bail hearing, but no date has yet been set.

In what is the first ever conviction of its kind anywhere in the world, the former US President and seven key members of his administration were today (Friday) found guilty of war crimes.
Bush, Dick Cheney, Donald Rumsfeld and their legal advisers Alberto Gonzales, David Addington, William Haynes, Jay Bybee and John Yoo were tried in absentia in Malaysia.
The trial held in Kuala Lumpur heard harrowing witness accounts from victims of torture who suffered at the hands of US soldiers and contractors in Iraq and Afghanistan.
They included testimony from British man Moazzam Begg, an ex-Guantanamo detainee and Iraqi woman Jameelah Abbas Hameedi who was tortured in the notorious Abu Ghraib prison.
At the end of the week-long hearing, the five-panel tribunal unanimously delivered guilty verdicts against Bush, Cheney, Rumsfeld and their key legal advisors who were all convicted as war criminals for torture and cruel, inhumane and degrading treatment.
Full transcripts of the charges, witness statements and other relevant material will now be sent to the Chief Prosecutor of the International Criminal Court, as well as the United Nations and the Security Council.
The Kuala Lumpur War Crimes Commission is also asking that the names of Bush, Cheney, Rumsfeld, Gonzales, Yoo, Bybee, Addington and Haynes be entered and included in the Commission’s Register of War Criminals for public record.
The tribunal is the initiative of Malaysia's retired Prime Minister Mahathir Mohamad, who staunchly opposed the American-led invasion of Iraq in 2003.
He sat through the entire hearing as it took personal statements and testimonies of three witnesses namely Abbas Abid, Moazzam Begg and Jameelah Hameedi. The tribunal also heard two other Statutory Declarations of Iraqi citizen Ali Shalal and Rahul Ahmed, another British citizen.
After the guilty verdict reached by five senior judges was delivered, Mahathir Mohamad said: “Powerful countries are getting away with murder.”
War crimes expert and lawyer Francis Boyle, professor of international law at the University of Illinois College of Law in America, was part of the prosecution team.
After the case he said: “This is the first conviction of these people anywhere in the world.”
While the hearing is regarded by some as being purely symbolic, human rights activist Boyle said he was hopeful that Bush and Co could soon find themselves facing similar trials elsewhere in the world.
“We tried three times to get Bush in Canada but were thwarted by the Canadian Government, then we scared Bush out of going to Switzerland. The Spanish attempt failed because of the government there and the same happened in Germany.”
Boyle then referenced the Nuremberg Charter which was used as the format for the tribunal when asked about the credibility of the initiative in Malaysia. He quoted: “Leaders, organizers, instigators and accomplices participating in the formulation or execution of a common plan or conspiracy to commit war crimes are responsible for all acts performed by any person in execution of such a plan.”
The US is subject to customary international law and to the Principles of the Nuremberg Charter said Boyle who also believes the week-long trial was “almost certainly” being monitored closely by both Pentagon and White House officials.
Professor Gurdial Singh Nijar, who headed the prosecution said: “The tribunal was very careful to adhere scrupulously to the regulations drawn up by the Nuremberg courts and the International Criminal Courts”.
He added that he was optimistic the tribunal would be followed up elsewhere in the world where “countries have a duty to try war criminals” and he cited the case of the former Chilean dictator Augustine Pinochet who was arrested in Britain to be extradited to Spain on charges of war crimes.
“Pinochet was only eight years out of his presidency when that happened.”
The Pinochet case was the first time that several European judges applied the principle of universal jurisdiction, declaring themselves competent to judge crimes committed by former heads of state, despite local amnesty laws.
Throughout the week the tribunal was packed with legal experts and law students as witnesses gave testimony and then cross examination by the defence led by lawyer Jason Kay Kit Leon.
The court heard how
· Abbas Abid, a 48-year-old engineer from Fallujah in Iraq had his fingernails removed by pliers.
· Ali Shalal was attached with bare electrical wires and electrocuted and hung from a wall.
· Moazzam Begg was beaten, hooded and put in solitary confinement.
· Jameelah was stripped and humiliated, and was used as a human shield whilst being transported by helicopter.
The witnesses also detailed how they have residual injuries till today.
Moazzam Begg, now working as a director for the London-based human rights group Cageprisoners said he was delighted with the verdict, but added: “When people talk about Nuremberg you have to remember those tried were all prosecuted after the war.
“Right now Guantanamo is still open, people are still being held there and are still being tortured there.”
In response to questions about the difference between the Bush and Obama Administrations, he added: “If President Bush was the President of extra-judicial torture then US President Barak Obama is the President of extra judicial killing through drone strikes. Our work has only just begun.”
The prosecution case rested on proving how the decision-makers at the highest level President Bush, Vice-President Cheney, Secretary of Defence Rumsfeld, aided and abetted by the lawyers and the other commanders and CIA officials – all acted in concert. Torture was systematically applied and became an accepted norm.
According to the prosecution, the testimony of all the witnesses exposed a sustained perpetration of brutal, barbaric, cruel and dehumanising course of conduct against them.
These acts of crimes were applied cumulatively to inflict the worst possible pain and suffering, said lawyers.
The president of the tribunal Tan Sri Dato Lamin bin Haji Mohd Yunus Lamin, found that the prosecution had established beyond a “reasonable doubt that the accused persons, former President George Bush and his co-conspirators engaged in a web of instructions, memos, directives, legal advice and action that established a common plan and purpose, joint enterprise and/or conspiracy to commit the crimes of Torture and War Crimes, including and not limited to a common plan and purpose to commit the following crimes in relation to the “War on Terror” and the wars launched by the U.S. and others in Afghanistan and Iraq.”
President Lamin told a packed courtroom: “As a tribunal of conscience, the Tribunal is fully aware that its verdict is merely declaratory in nature. The tribunal has no power of enforcement, no power to impose any custodial sentence on any one or more of the 8 convicted persons. What we can do, under Article 31 of Chapter VI of Part 2 of the Charter is to recommend to the Kuala Lumpur War Crimes Commission to submit this finding of conviction by the Tribunal, together with a record of these proceedings, to the Chief Prosecutor of the International Criminal Court, as well as the United Nations and the Security Council.
“The Tribunal also recommends to the Kuala Lumpur War Crimes Commission that the names of all the 8 convicted persons be entered and included in the Commission’s Register of War Criminals and be publicised accordingly.
“The Tribunal recommends to the War Crimes Commission to give the widest international publicity to this conviction and grant of reparations, as these are universal crimes for which there is a responsibility upon nations to institute prosecutions if any of these Accused persons may enter their jurisdictions”.

"Radical" cleric Abu Qatada has been refused bail after a
judge said significant jihadist material was found on a computer memory
stick.
Qatada, who recently indicated he was willing to leave the UK voluntarily after years fighting deportation, must remain in custody after immigration judge Mr Justice Irwin's ruling.
The judge said: "We regard these breaches as serious. It was the appellant's obligation to understand the conditions of bail and ensure they were adhered to.
"A serious matter relating to the breaches of bail was revealed during the hearing.
"In his witness statement, the appellant assured the Commission that nothing would be found on any of these items other than schoolwork or other innocent material.
"This assurance has proved untrue. Significant jihadist material has been found on a USB stick seized."
Mr Justice Irwin also said there was "no doubt about the national security threat" the radical cleric poses to Britain.
"The essence of that is promulgation of his views in support of violence, and the potential effect on others of that promulgation," he said.
"This appellant has in the past fled in order to avoid a court order, equipping himself with a false passport.
"We reject the submission that he can, even now, be relied on to comply with his legal obligations and not to attempt to abscond."
Earlier this month, it emerged the controversial preacher is willing to return to the Middle East when a treaty between the UK and Jordan is ratified by both countries.
The agreement, unveiled by Home Secretary Theresa May last month, aims to allay fears that evidence extracted through torture will be used against the terror suspect at a retrial.
Qatada's lawyer Daniel Friedman QC told the hearing that the treaty also "raises his prospects of acquittal in relation to what we say are tainted charges".
Mr Friedman argued that Qatada was a "proud and dignified man" who has been held in custody for too long.
He added his client "has been deprived of his liberty more than any other non-convicted person in British history".
